Asset Preservation & Emergency Relief in China
When a Chinese debtor may transfer, conceal, or dissipate assets, we assess whether a PRC property-preservation application is available and how it should connect to the underlying claim or enforcement strategy.
The timing of the claim may matter as much as the merits.
A strong contract or judgment does not by itself keep assets available. The key questions are whether there is a legally supportable urgency, what property information exists, what security may be required, and whether the next filing step is ready.
What we assess
We separate verified facts, available documents, legal conditions, and practical next steps.
- Whether the matter is pre-suit, pending litigation, recognition, or post-judgment enforcement.
- The factual basis for urgency and the property information available to the court.
- The amount and type of security that may be required, including practical options for a foreign applicant.
- Whether the requested measure is proportionate to the claim and connected to an executable legal strategy.
- The filing sequence after preservation, including the risk of relying on an order without preparing the next step.
How the work usually develops
Indicative stages only. The route, timing, and filing requirements depend on the matter and destination forum.
Preserve the facts
We identify the evidence showing urgency, dissipation risk, and the property or entity involved.
Plan the guarantee
We assess the likely security requirements and the documents needed for the application.
Submit the application
The application is prepared for the competent court and tied to the underlying claim or proceeding.
Protect the legal strategy
We coordinate the required lawsuit, arbitration, recognition, or enforcement step and monitor the preservation risk.
Preservation is not automatic and is not a guarantee of collection. The court decides whether to grant relief, what security to require, and what property may be covered. Pre-suit, in-litigation, and post-judgment measures must be analyzed separately.
What to prepare for an assessment
- Claim evidence, amount and the respondent's registered identity.
- Dated facts supporting urgency and concrete property information.
- Available security and readiness for the required follow-on proceeding.
Costs, timing and recovery risk
Separate the court application fee from legal work, security, collateral and an insurer's premium. Court acceptance and property value are not assured.

Common questions
In some circumstances, PRC law permits a pre-suit application, but urgency, jurisdiction, security, and the follow-on filing requirement must be assessed from the facts.
The procedure and timing depend on the measure and the court. We do not promise an ex parte result; we assess the available procedure and risks before filing.
Specific property information is important. We assess what reliable leads exist and whether a court-assisted inquiry or another measure is legally available.
