A foreign arbitral award does not itself transfer money from a Chinese debtor. The creditor must identify the applicable recognition and enforcement route, prepare the court application and assess assets that can lawfully be reached in mainland China.
Start with the award's seat and the debtor's registered identity. The name of the arbitration institution alone does not determine the enforcement route.
Which route applies?
For an award made in a foreign state, examine the New York Convention, China's reservations and applicable Chinese procedure. An award made in Hong Kong follows the separate mainland–Hong Kong arrangement; it should not be treated as an ordinary foreign-state award. Mainland awards have their own domestic enforcement route.
Under Civil Procedure Law Article 304, the intermediate people's court at the respondent's domicile or property location is the usual application forum for a foreign award. If neither is in China, the provision allows an application at the applicant's domicile or another place appropriately connected with the dispute. Documents and refusal risks
Article IV of the New York Convention requires the authenticated original award or certified copy and the original arbitration agreement or certified copy. Where necessary, certified translations must accompany them. Check the receiving court's filing requirements for company authority documents and the application as well.
Article V permits refusal on limited grounds: incapacity or an invalid arbitration agreement; deficient notice or inability to present a case; an award outside the agreed scope; irregular tribunal composition or procedure; or an award not yet binding, set aside or suspended at the seat. The court may also consider non-arbitrability and public policy. These are not an ordinary appeal on the merits.

Does an invalid contract invalidate the arbitration clause?
Not automatically. Under Article 30 of China's revised Arbitration Law, the arbitration agreement is independent of the main contract. A dispute over the contract's formation, effectiveness, termination or validity does not itself eliminate an agreed arbitration clause. Recognition and recovery are separate questions
Prepare two workstreams before committing to proceedings:
- Recognition: identify the seat, agreement, parties, award status, notice evidence, translations and possible refusal objections.
- Recovery: confirm the mainland debtor's identity, asset leads, existing enforcement cases, possible security interests and signs of insolvency.
A recognized award can remain unpaid when there are no reachable assets. Share actual asset clues with counsel; a trading name or a related company's property is not proof that the award debtor owns enforceable assets. See asset investigation.
What should the budget and schedule cover?
Ask for a written scope separating the recognition application, preservation work, execution, translations and other third-party expenses. Check court fees for the specific application rather than applying the ordinary monetary-lawsuit filing formula to every award matter.
Service, objections, document preparation and asset issues affect the timetable. An estimate for court recognition should not be presented as a date by which payment will arrive.
Prepare an initial inquiry
Provide the award seat and date, the parties' legal names, outstanding amount and a short description of known mainland assets. Mention any setting-aside proceedings or settlement discussions. The initial inquiry can identify what counsel needs next; it is not a guarantee of acceptance, recognition or recovery.
